I. DATA CONTROLLER AND DATA PROTECTION OFFICER

II. COLLECTION AND STORAGE OF PERSONAL DATA AND THEIR NATURE, PURPOSE AND USE

1. By visiting the website

When you access the CHIBERTA CREATION website, the browser installed on your terminal automatically sends information to the server of our website. This information is temporarily stored in a log file.The following information is collected without your intervention and automatically deleted within four weeks:
IP address of the visiting device, date and time of access,
type and version of the browser as well as other information transmitted by the browser (such as the operating system of the visiting device, the name of your access provider, the geographical origin, the language setting, etc.)

The legal basis for the data processing is Art. 6, para 1, point f of the GDPR. The company has a legitimate interest in collecting and processing the above-mentioned data for the purpose of:
Ensuring a good connection of the company's website,
Ensuring a comfortable use of our website
Evaluating the security and stability of the systems
Administrative management
We do not use the collected data in any way for the purpose of being able to draw conclusions about your person.

The deletion of your data stored with our company does not preclude this data from being stored by our hosting provider for a period of time long enough for the prosecution of criminal offences under statutory obligations in accordance with Art. 6, para. 1, point c of the GDPR.
We also use cookies and analysis services when you visit our website. You will find more detailed information on this subject under numbers 4 and 5 of this data protection declaration.

2. Place an order as a guest

If you wish to order products as a guest on our website, we collect the following information:
Title, first name, surname
Valid e-mail address
Address and country
Date of birth
Payment details, depending on the payment method you have chosen (e.g. credit card details or bank details)

This data is collected:
To identify you as a contractual partner
To check the plausibility of the data entered
To process the payment of your order
To settle any warranty claims that may exist and to exercise any claims against you

The data processing is carried out at your request and is necessary in accordance with Art. 6, para. 1, b of the GDPR for the purposes indicated for the execution of the contract and pre-contractual measures.
In order to ensure a simple and fast processing of your order and to answer all your questions more quickly, you also have the possibility to provide additional information:
Your telephone number and mobile phone number
An alternative delivery address
The provision of this data is optional.
The personal data collected for the order will be stored until the expiry of the legal warranty obligation and will be automatically deleted, unless a storage obligation according to Art. 6, para. 1, point c of the GDPR referring to a longer storage obligation due to fiscal and commercial storage and documentation obligations or you have consented to a storage beyond this according to Art. 6, para. 1, point a of the GDPR.

3. When creating a Customer account

You have the option of creating a password-protected customer account where we store your personal data. This is to make it easier for you to process your orders in a simple, fast and personal way.
If you wish to create a password-protected customer account, the following information will be required:
First name, last name
A valid e-mail address
In addition, you will need to enter a password of your choice to create a customer account. These elements will allow you to access your account along with your e-mail address. In your customer account, you can consult and modify your stored data at any time.
For faster contact, you can also enter your mobile phone number. This information is optional and is not required to create a customer account.
The data is processed at your request and, in accordance with Art. 6, para. 1, point b of the GDPR, is required for the assigned purposes of contract execution and pre-contractual measures.
You do not need to create a customer account to use the website or place orders. We offer you the possibility to place your order as a guest (see 2. b). In this case, however, you will have to re-enter your data for each new order.
After deletion of your Customer account, your data will be automatically deleted, unless we are obliged to retain your data for a longer period of time in accordance with Art. 6 (1) (c) of the GDPR due to fiscal and commercial retention and documentation obligations or you have consented to additional retention in accordance with Art. 6 (1) (c) of the GDPR.

4. When you subscribe to our newsletter

If you have given your express consent in accordance with Art. 6, para. 1, point a of the GDPR, we use your e-mail address to send you our personalised newsletter on a regular basis. To be able to receive the newsletter, you only need to enter an email address.

5. By using our contact form

If you have any questions whatsoever, you can contact us via a contact form available on the CONTACT page. To do so, you need to provide a valid e-mail address, your first name and the subject of your request so that we know who sent us the request and how to respond.
The data for contacting us is processed within the meaning of Article 6(1)(f) of the GDPR on the basis of our legitimate interests.
The personal data we have collected for the use of the contact form will be automatically deleted once your request has been satisfied.

III. COOKIES

We use cookies. These are small files that your browser automatically creates and which are stored on your mobile device (laptop, tablet, smartphone or similar) when you visit the site. Cookies do not cause any damage to your device, they do not contain viruses, trojans or other malware.

IV. ANALYTICAL TOOLS

The tracking and targeting measures described below, which we have implemented, are carried out on the basis of Art. 6 (1) (f) GDPR.With the tracking measures used, we want to ensure that our website is designed to meet the needs of our customers and that our website is continuously optimized. On the other hand, we also use tracking measures to statistically record the use of our website and to evaluate it for you with the aim of optimizing our offer.

2. Facebook Custom Audiences

We also use Facebook Website Custom Audiences from Facebook Ireland Ltd (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). This is a Facebook marketing service that enables us to display personalised, interest-based advertising on Facebook to certain groups of pseudonymised visitors to our website who also use Facebook.
A Facebook Custom Audience pixel is embedded in our website. This is a JavaScript code that stores personal data about the use of the website. This includes your IP address, your browser software and the source and target page. This information is transferred to Facebook servers in the U.S. Facebook is subject to the EU-U.S. Privacy Shield, which guarantees an adequate level of data protection.On these servers, it is automatically determined whether you have saved a Facebook cookie. Pursuant to Art. 20 GDPR, you can demand your personal data that you have provided to us in a structured, common and machine-readable format or demand that it be transferred to another responsible person;
Pursuant to Art. 7, para. 3 GDPR, you have the right to revoke your consent at any time. As a result, we are no longer entitled to continue processing data on the basis of this consent for the future, and lodge a complaint with a supervisory authority in accordance with Art. 77 of the GDPR. As a rule, you can contact the supervisory authority at your usual place of residence or work or at our registered office for this purpose.
